Terms of Use

Last updated: August 4, 2026

By using TMP Guide (the "Service"), you agree to these Terms. If you don't agree, don't use the Service. These Terms govern your use of the Service.

1. Not affiliated with Fender

TMP Guide is an independent, fan-created reference guide. It is not affiliated with, endorsed by, or sponsored by Fender Musical Instruments Corporation ("Fender") or any of its subsidiaries. "Fender," "Tone Master," "Tone Master Pro," and any related trademarks and logos are the property of Fender or its licensors. All references on this site are for identification and interoperability purposes only.

2. Preset downloads — provided as-is

The Service can generate .preset files intended to be loaded onto a Fender Tone Master Pro device via the Fender Pro Control application. These files are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or compatibility with any particular firmware version or hardware revision.

You use, download, and load presets entirely at your own risk. You are solely responsible for backing up any existing presets before loading new ones, verifying that a generated preset is appropriate for your intended use before performing with it, and confirming compatibility with your device's current firmware. To the extent permitted by law, TMP Guide, its creator(s), and any contributors disclaim all liability for damage or data loss arising from downloading, loading, or using any preset produced by the Service.

The AI models that generate presets are probabilistic and may produce output that is inaccurate, unsuitable for performance, unstable, unexpectedly loud, sonically harsh, otherwise undesirable, or unrepresentative of the artist/gear/tone described. Treat all AI-generated content as a suggestion, not a specification.

Any generated preset must be tested carefully, at low volume, in a controlled environment before rehearsal, recording, livestream, or live performance use. You are solely responsible for monitoring output levels, signal routing, and device behavior after loading any generated preset.

We may suspend preset export, withdraw access to previously generated presets, mark specific presets as unsafe or unsupported, or instruct users to stop using particular generated presets if we identify safety, stability, compatibility, performance, or reliability concerns. If we notify users that a generated preset should no longer be used, you agree to stop loading, using, sharing, and redistributing it immediately.

3. Accounts

Sign-in is required to use the AI-powered tools (Tone Builder and AI Manual) and to download .preset files when that feature is available. Sign-in uses passwordless magic links delivered via email — no password to remember or manage. You are responsible for keeping the email address you sign in with secure and for actions taken under your account.

Usage of the Service is currently offered free of charge, subject to rate limits and feature limits. We may suspend, restrict, or terminate access to accounts or features if we reasonably believe there is abuse, fraud, unlawful activity, security risk, or a violation of these Terms.

4. Paid subscriptions and billing

Some features may be offered on a paid subscription basis now or in the future. If you choose a paid plan, you authorize the recurring charges and any applicable taxes disclosed at checkout. Unless stated otherwise at checkout, paid subscriptions renew automatically until canceled.

If a paid subscription is available, you may cancel it through the self-serve billing portal or other cancellation flow then offered with the Service. Cancellation stops future renewals but does not retroactively refund or prorate charges already paid, except where required by law or expressly stated by us at the time of purchase. We may change pricing or plan features prospectively by updating the Service or providing notice before the change takes effect.

5. Acceptable use

You agree not to: (a) attempt to interfere with, disable, or circumvent any feature of the Service, including rate-limiting or the provenance watermark described in Section 16; (b) automate access or scrape content at a rate that would be disruptive; (c) use the Service to create content that is illegal, harmful, harassing, or that infringes anyone's rights; (d) resell, sublicense, repackage, redistribute for a fee, or otherwise commercially exploit any .preset file or other content generated by the Service, whether in its original form, edited, rebranded, bundled with other content, or as part of a preset pack, tone library, subscription, marketplace listing, or paid resource of any kind; or (e) redistribute generated presets in a way that misrepresents their origin (including removing or altering the embedded provenance identifier described in Section 16).

6. Intellectual property

The Service itself — site code, database, UI, documentation — is the property of the TMP Guide creator(s) and may not be copied without permission. Third-party trademarks are the property of their respective owners.

Generated .preset files are licensed to you for personal, non-commercial use on your own Fender Tone Master Pro device, including personal live performance, personal recording, and non-commercial sharing with friends or bandmates for the same personal use. You may not resell them, include them in a paid product, or otherwise commercially exploit them — see Section 5(d) for the full scope. Nothing in this Section grants you any rights in the Service's underlying model catalog, cabinet impulse responses, or gear metadata, all of which remain proprietary to TMP Guide or the underlying rights-holders.

7. Third-party services

The Service uses third-party providers for payment processing, transactional email delivery, analytics and event logging, cloud hosting, and large-language-model inference. Your data may be processed by these providers as necessary to operate the Service. Their terms and privacy policies apply to their portions of the flow.

8. Affiliate links

Some outbound links on this site are affiliate links. If you purchase through them, TMP Guide may earn a small commission at no additional cost to you. As an Amazon Associate, TMP Guide earns from qualifying purchases.

9. Service availability

We may add, remove, suspend, disable, withdraw, or change any part of the Service at any time, including features, rate limits, supported models, generated outputs, pricing, or availability. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

Without limiting the foregoing, we may temporarily or permanently disable preset export, invalidate or withdraw previously generated presets, or require additional warnings, confirmation steps, or testing guidance before allowing access to certain outputs.

10. Indemnification

You agree to defend, indemnify, and hold harmless TMP Guide, its creator(s), and contributors from and against any third-party claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your loading, sharing, redistribution, resale, or commercial exploitation of any generated preset or other output; (c) your violation of these Terms; (d) content, specifications, or instructions you submit to the Service; or (e) your violation of any law or any third party's rights.

11. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall TMP Guide, its creator(s), or contributors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or use, arising out of or related to your use of the Service or any .preset file generated by it, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not TMP Guide has been advised of the possibility of such damage. In no event shall the aggregate liability of TMP Guide for any claims arising out of or relating to these Terms or the Service exceed the total amount you paid to TMP Guide, if any, in the twelve (12) months immediately preceding the event giving rise to the claim. If you have not paid TMP Guide any amount, TMP Guide's aggregate liability to you shall be zero.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above and, where appropriate, communicated by email to signed-in users. Continued use of the Service after an update constitutes acceptance of the updated Terms.

13. Governing law and venue

These Terms and any dispute arising out of or relating to the Service shall be governed by the laws of the State of Alabama, without regard to its conflict-of-laws principles. Any dispute that is not resolved informally shall be brought exclusively in the state or federal courts located in Alabama, and you consent to the personal jurisdiction and venue of those courts.

Before filing any legal claim arising out of or relating to the Service, you agree to send written notice describing the claim in reasonable detail and allow TMP Guide at least thirty (30) days to attempt to resolve it informally.

14. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with any pricing or checkout terms presented to you for paid features, form the entire agreement between you and TMP Guide regarding the Service.

16. Provenance identifier (watermarking)

Every .preset file generated by the Service contains a non-user-visible provenance identifier embedded in the file's metadata. This identifier is a cryptographic signature that lets TMP Guide verify, from a copy of the file alone, that the preset was produced by the Service. The identifier does not include your name, email address, or any information you provided in your prompt — it is a random-looking string that only TMP Guide can meaningfully interpret.

TMP Guide separately maintains an internal record associating each generated preset with the signed-in account that requested it, retained solely so that provenance can be attributed if a preset is later found being distributed in violation of Section 5. This record is not shared with third parties except as required by law or as necessary to enforce these Terms. Removing, obscuring, or attempting to spoof the provenance identifier is a violation of Section 5(a) and Section 5(e).
